Terms and Conditions
Last Updated: October 9th, 2026
These Terms and Conditions (“Terms”) govern your use of the Maykyn website, online courses, and related services (“Services”). The Services are operated by Maykyn (“Maykyn,” “we,” “us,” or “our”). By using our website, creating an account, or purchasing a course, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to create an account or purchase a course. If you are under18, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services.
2. Use of Our Courses
Maykyn provides educational courses and materials related to the business of art. When you purchase or are granted access to a course, Maykyn grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the course materials for your own personal, non-commercial educational use, subject to these Terms.
You may not copy, reproduce, distribute, resell, publish, share, or make course materials available to others without written permission from Maykyn.
3. Duration of Access
Unless a different access period is stated on the course purchase page, your access to a purchased course lasts for three (3) months from the date of purchase. When the access period ends, your access to the course, including any materials not already downloaded, will end automatically. Any period during which your access is suspended under these Terms does not extend the access period.
If we permanently discontinue a course before your access period ends, we will make reasonable efforts to give you advance notice [and may, at our discretion, offer a pro-rated refund or access to a comparable course].
4. Accounts and Access
You are responsible for maintaining the confidentiality of your account information and for all activity conducted through your account. Please notify us promptly at support@maykyn.com if you believe your account has been accessed without authorization.
Course access is intended only for the individual who purchased or was granted access to the course. Accounts may not be shared, transferred, or used by more than one person.
5. Payments
Prices are listed on our website and may change from time to time. Price changes do not affect courses you have already purchased. Payments are processed through third-party payment providers, including Squarespace Payments. You agree to provide accurate billing and payment information when making a purchase, and you authorize us and our payment providers to charge your selected payment method.
You are responsible for any applicable sales, use, or similar taxes, which may be added at checkout where required by law.
6. Refunds
All sales are final. Maykyn generally does not offer refunds once a course has been purchased. If you believe special circumstances justify a refund, you may submit a request by email to support@maykyn.com. Please include your name, the course purchased, the date of purchase, and a description of the circumstances. To be considered, your request must be made before you have watched any course videos or downloaded any course materials. Requests made after you have watched course videos or downloaded course materials will not be considered.
We will review timely requests on a case-by-case basis. Whether to grant a refund, in whole or in part, is within Maykyn’s sole discretion, and granting a refund in one case does not obligate us to grant one in any other case. If a refund is granted, your access to the course will end.
Customers in the European Union and United Kingdom. You may have a statutory right to withdraw from a purchase of digital content within 14 days. By purchasing a course and requesting immediate access, you expressly consent to access beginning before the withdrawal period ends and acknowledge that you lose your right of withdrawal once access begins.
7. Chargebacks
If you believe a charge is incorrect, please contact us at support@maykyn.com before disputing it with your bank or card issuer so we can try to resolve it. If you initiate a chargeback or payment dispute for a purchase you received, we may suspend or terminate your access to the Services while the dispute is pending, and permanently if the dispute is resolved in our favor.
8. Educational Information Only; No Legal or Professional Advice
General information only. Maykyn courses, materials, templates, live sessions, and communications are provided for general educational and informational purposes. They are not tailored to your individual circumstances and are not legal, tax, accounting, financial, investment, or other professional advice.
No attorney-client relationship. One of Maykyn’s founders and instructor, Kim Piermattei, Esq., is a licensed attorney. However, Kim Piermattei is acting solely as an educator in connection with the Services, not as your attorney. No attorney-client relationship is created by purchasing or accessing a course, participating in a live session or Q&A, posting in a community space, or communicating with Maykyn or its instructors by email, direct message, comment, or any other means. An attorney-client relationship with Kim Piermattei can be formed only through a separate, signed written engagement agreement.
No confidentiality. Because no attorney-client relationship exists, communications with Maykyn and its instructors are not privileged or confidential. Please do not send confidential or sensitive information about your legal matters through the Services, in community spaces, or by email. Sharing such information will not create an attorney-client relationship or any duty of confidentiality.
Jurisdiction and currency of information. Kim Piermattei is licensed to practice law only in Pennsylvania. Laws differ by state and country and change over time. Course content reflects general principles as of the date it was created, may not reflect the law in your jurisdiction, and may not reflect later legal developments.
Templates and sample documents. Any contracts, forms, checklists, or sample language provided in a course are educational examples and starting points only. They may not be suitable for your situation or enforceable in your jurisdiction. You are solely responsible for how you use them, and you should have any document you intend to rely on reviewed by a qualified attorney licensed where you live or do business. Do not rely on course content as a substitute for professional advice. You should not act, or refrain from acting, based on course content without first seeking advice from an appropriately licensed attorney, accountant, tax advisor, or other professional who can evaluate your specific circumstances.
Other instructors. Guest instructors and contributors share their own views and experience.
Unless expressly stated, they are not acting as professional advisors to you, and their views do not necessarily reflect Maykyn’s.
9. No Guarantee of Results
We provide practical business guidance for artists, but we do not guarantee any specific financial, sales, marketing, career, or business results. Your results depend on many factors outside our control, including your skills, effort, market conditions, and business decisions.
Any testimonials, case studies, or examples of student or instructor success shared on our website or in our courses reflect individual experiences. They are not typical and are not a promise or prediction that you will achieve similar results. Any income or sales figures mentioned are illustrative only.
10. Intellectual Property
All Maykyn course materials, videos, text, graphics, downloads, templates, branding, and other content are owned by Maykyn or used with permission and are protected by applicable intellectual property laws.
You may download materials specifically made available for personal use, but ownership of those materials remains with Maykyn. Except for the limited license in Section 2, no rights are granted to you, by implication or otherwise.
11. Artificial Intelligence Tools
You may not upload, input, or submit course materials, including videos, transcripts, text, templates, or downloads, into any artificial intelligence or machine learning tool, model, or service. You also may not use course materials to train, fine-tune, or develop any such tool or model, or to create derivative or competing products, without Maykyn’s prior written permission.
12. Your Content and Artwork
Some courses may allow you to post comments, questions, images of your artwork, or other materials (“Your Content”). You retain all ownership rights in Your Content, including the copyright in your artwork. By submitting Your Content, you grant Maykyn a non-exclusive, royalty-free, worldwide license to host, display, and reproduce it solely to operate and provide the Services, such as displaying it to other enrolled students in a course or community space. We will not use your artwork in advertising or marketing, or publish it outside the Services, without your separate permission. You represent that you own or have the rights to Your Content and that it does not infringe anyone else’s rights. You may request removal of Your Content by contacting support@maykyn.com.
If you send us suggestions or feedback about the Services, we may use them without restriction or obligation to you.
13. Community Guidelines
Where the Services include community spaces, comments, or live sessions, you agree to be respectful and not to post content that is unlawful, harassing, hateful, defamatory, infringing, or promotional spam. Do not share other students’ work or personal information outside the Services. We may remove content or restrict access to community features at our discretion.
14. Live Sessions and Recordings
Live sessions, workshops, and Q&As may be recorded and made available to enrolled students as part of the course. By participating, you consent to being recorded, including your name, image, voice, and any questions or comments you share. If you do not wish to appear in a recording, you may turn off your camera, use a display name, or submit questions in writing.
15. Acceptable Use
You may not use our website or Services to:
Violate any law or regulation
Interfere with the operation or security of the website
Attempt to gain unauthorized access to accounts or systems
Copy, scrape, download (except as expressly permitted), reproduce, or commercially exploit our content
Record, screen-capture, or rebroadcast course videos or live sessions
Share login credentials or course access with others
16. Privacy
Our collection and use of your personal information is described in our Privacy Policy.
17. Third-Party Services and Links
Our website may use or link to third-party services, including Squarespace, Google, and other providers. Maykyn is not responsible for the availability, content, privacy practices, or operation of third-party websites or services, and your use of them is governed by their own terms.
18. Availability of Services
We make reasonable efforts to keep our website and courses available, but we cannot guarantee uninterrupted or error-free access. We may modify, update, discontinue, or replace website features, course materials, or services when reasonably necessary. Updates to a course do not entitle you to a refund.
19. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, COURSES, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY. MAYKYN DOES NOT WARRANT THAT COURSE CONTENT IS COMPLETE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAYKYN AND ITS OWNERS, INSTRUCTORS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATING TO YOUR USE OF THE WEBSITE, COURSES, OR SERVICES, OR YOUR RELIANCE ON ANY COURSE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MAYKYN’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR A PURCHASED COURSE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT COURSE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
21. Indemnification
You agree to indemnify, defend, and hold harmless Maykyn and its owners, instructors, employees, and contractors from any claims, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising from (a) your violation of these Terms, (b) your misuse of the Services or course materials, or (c) Your Content.
22. Suspension and Termination
We may suspend or terminate your access to the Services, without refund, if you violate these Terms, including by sharing your account, redistributing course materials, or engaging in abusive conduct. You may stop using the Services at any time.
Sections 8 through 12, 19 through 21, and 23 through 26 survive any termination or expiration of your access.
23. Informal Dispute Resolution
Before filing any claim, you agree to first contact us at support@maykyn.com with a description of the dispute and give us 30 days to try to resolve it informally.
24. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.
25. Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on this page with a revised “Last Updated” date. For material changes, we will also make reasonable efforts to notify you by email or through the Services.
Changes apply going forward and do not apply to disputes that arose before the change was posted. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
26. General Provisions
Entire agreement. These Terms, together with our Privacy Policy and any access period stated on a course purchase page, are the entire agreement between you and Maykyn regarding the Services.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms or your course access. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including platform outages, internet failures, or natural disasters.
Electronic communications. You agree to receive communications from us electronically, and electronic notices satisfy any requirement that notices be in writing.
